Terms of Service

Agreement Overview

These Terms and Conditions ("Terms") govern your access to and use of the QueueStream website, web and mobile applications, and all services, modules, and APIs. By accessing or using our platform, you agree to these Terms. If you do not agree, discontinue use immediately.

Definitions

  • "Client" — The organisation or authorised user subscribing to QueueStream.
  • "End User" — A customer or visitor who interacts with the client's queue or feedback system.
  • "Subscription" — The paid or trial access granted to the QueueStream SaaS platform.
  • "Services" — All QueueStream modules, tools, dashboards, APIs, and apps.
  • "Content" — Any information, data, text, or media provided through QueueStream.

Eligibility

To use QueueStream, you must:

  • Be at least 18 years old or authorised to act on behalf of a legal business entity.
  • Provide accurate and verifiable information during registration.
  • Comply with all applicable laws and regulations.

We reserve the right to suspend or terminate accounts providing false or misleading information.

Account Registration

  • Each client must create an account to access QueueStream services.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • Do not share credentials with unauthorised users.
  • QueueStream is not liable for losses resulting from unauthorised access.

Subscription, Payments & Billing

QueueStream operates on a subscription-based pricing model (monthly, annual, or enterprise). Subscriptions auto-renew unless cancelled before the renewal date. Invoices are generated electronically; taxes and conversion charges may apply.

Refunds

  • Subscription fees are non-refundable, except where required by law.
  • Partial or mid-cycle refunds are not issued for cancelled plans.
  • Free trials can be cancelled anytime before billing starts.

Acceptable Use

You agree to use QueueStream only for lawful business purposes. You must not:

  • Copy, modify, reverse-engineer, or resell the software.
  • Upload harmful or illegal content.
  • Attempt unauthorised access to QueueStream systems.
  • Misuse the system to send spam or false notifications.

Violations may result in immediate suspension or termination.

Client Data & Responsibilities

  • You (the client) are the data controller for your customer data.
  • QueueStream acts as a data processor, securely storing and managing data on your behalf.
  • You are responsible for obtaining customer consent for data processing where required by law.
  • QueueStream will never use or share your data beyond service delivery.

Intellectual Property

  • All software, trademarks, content, and technology are owned by QueueStream or its licensors.
  • Clients retain ownership of their internal data and reports.
  • You receive a non-exclusive, non-transferable licence to use QueueStream for your operations.
  • Reproduction or modification without written consent is prohibited.

Third-Party Services

QueueStream integrates with third-party systems (e.g., SMS gateways, email providers, analytics tools). We are not liable for:

  • Downtime or errors caused by third-party systems.
  • Privacy practices of those providers.

Clients must review and comply with third-party terms where applicable.

Service Availability

  • We target 99.9% uptime and monitor performance continuously.
  • Interruptions may occur due to maintenance, updates, or unforeseen technical issues.
  • QueueStream is not liable for outages beyond its control, including power failures or natural disasters.

Data Privacy & Security

  • QueueStream complies with GDPR, CCPA, and DPDP (India).
  • All communications are encrypted via HTTPS/TLS.
  • Data is stored securely in cloud infrastructure (AWS/Azure).

Confidentiality

Both parties agree to:

  • Keep confidential information private and secure.
  • Use it only for contract-related purposes.
  • Not disclose it to third parties without consent.

This obligation continues after termination.

Data Ownership

  • You retain full ownership of your business data.
  • QueueStream only processes and stores data for operational purposes.
  • After cancellation, data can be exported upon request before permanent deletion.

Limitation of Liability

To the fullest extent permitted by law:

  • QueueStream shall not be liable for indirect or consequential damages.
  • Our total liability shall not exceed the amount paid in the last 12 months.
  • We are not responsible for issues caused by third-party systems or internet disruptions.

Warranties & Disclaimer

QueueStream is provided "as is" and "as available." We do not warrant that:

  • The platform will be uninterrupted or error-free.
  • It will meet every unique business requirement.
  • All data transmissions will be fully secure.

Termination

QueueStream may suspend or terminate access if:

  • Subscription fees are unpaid.
  • The client violates these Terms.
  • The platform is misused or security is compromised.

Data remains accessible for 90 days post-termination before permanent deletion.

Indemnification

You agree to indemnify and hold QueueStream harmless against any claims, damages, or losses arising from misuse, legal violations, or breach of these Terms.

Global Compliance

QueueStream complies with:

  • GDPR (EU/EEA)
  • CCPA (California, USA)
  • DPDP Act (India)

Clients must ensure their own compliance when processing customer data.

Governing Law & Jurisdiction

These Terms are governed by the laws of India, under the jurisdiction of Pune, Maharashtra. Global clients may resolve disputes through arbitration or mutual agreement under international standards.

Cancellation, Renewal & Refund Policy

  • Subscription Cancellation: Clients may cancel anytime via the Admin Dashboard or by emailing support@queuestream.pro. Access continues until the end of the paid cycle.
  • Automatic Renewal: Plans auto-renew unless cancelled at least 3 days before the renewal date.
  • Refunds: No-refund policy applies except in cases of prolonged downtime, duplicate payments, or legal obligation. Approved refunds are processed within 10–15 business days.
  • Data After Cancellation: Clients have 90 days to export data before permanent deletion.
  • Trial Periods: Free trials can be cancelled anytime before billing starts.
  • Enterprise Contracts: Early termination clauses follow the individual agreement.

Modifications to Terms

QueueStream may update these Terms periodically. Revised versions will be posted at https://www.queuestream.pro/terms. Continued use after updates constitutes acceptance of the new Terms.
